Terms of sale

The rules for buying Mapster maps and using them on your Lowrance.

1. Who we are

Mapster ("we", "us") is a South African business that makes satellite-imagery maps of dams for Lowrance fish finders and sells them at mapster.co.za, as downloads and on SD cards. You can reach us at rossco@live.co.za.

By placing an order you agree to these terms, our refund policy and our privacy policy. Please read all three before you pay.

2. Maps

Each map is a digital chart file of one named dam, made from satellite imagery for the Lowrance units listed on the map's page. The images on the site show the imagery used; how the map looks on your unit depends on the model, its software and the zoom level.

We describe each map as accurately as we can, including which units it works on. If you're not sure whether your unit is one of them, please ask before you buy.

3. Licence to use the map

When you buy a map you are buying a licence to use it, not the copyright in it. The licence is:

  • Personal: for your own recreational or commercial fishing, on Lowrance units you own or operate.
  • Non-transferable: you may not sell, rent, lend, give away or otherwise distribute the file or any copy of it, whether for free or for money.
  • Non-exclusive and perpetual: the licence doesn't expire, although the download link does (see section 5).

You may keep backup copies for your own use and load the map onto more than one card for your own units. You may not upload the file to file-sharing sites, forums or groups, decompile or modify it, or remove any identifying marks. Mapster keeps all intellectual property rights in the maps.

4. Prices and payment

All prices are in South African rand. Mapster is not registered for VAT, so no VAT is charged and our invoices show none. The total at the checkout, which includes the SD card if you add it and any discount code, is the amount you pay. We may change prices at any time, but a change doesn't affect an order already placed.

Payment is processed by PayFast (Pty) Ltd, a registered South African payment service provider, using the payment methods PayFast offers. Card details are entered on PayFast's pages and are never received or stored by Mapster. Your order is confirmed only once PayFast tells us the payment has been received.

5. Download links

Once payment is confirmed we email you a download link for each map in your order, and the same links appear on your order page. Each link is valid for 30 days and allows 5 downloads of each file. You are responsible for downloading the file and keeping it safe within that time, although we will extend a link on reasonable request.

6. SD cards

If you add the SD card to your order, we write every map in the order onto one 32GB SD card and post it PostNet-to-PostNet to the PostNet branch you enter at the checkout. The SD card fee of R350 is charged once per order and covers the card and the postage. SD cards are posted within South Africa only.

Delivery times shown on the site are estimates, and PostNet's own terms govern its service. Risk in the card passes to you when you collect it. A parcel not collected within PostNet's holding period may be returned to us, in which case posting it again is at your cost.

Please enter an accurate cell number, because PostNet uses it to tell you the parcel has arrived. The delivery page has the details.

7. Refunds and returns

Our refund policy forms part of these terms and sets out your rights under the Consumer Protection Act, 2008, including for defective goods.

8. Using the maps safely

Our maps are an aid to fishing, not for navigation. Satellite imagery shows conditions on the day it was captured, and water levels, structure and hazards change. Never rely only on an electronic chart to navigate safely. You are responsible for operating your boat safely and for complying with local regulations and dam permits.

9. Liability

To the extent the law allows, our liability for any claim arising from a purchase is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including damage to equipment or lost fishing time. Nothing in these terms limits any right you have under the Consumer Protection Act that cannot be excluded.

10. Trademarks

Lowrance, HDS and Elite are trademarks of Navico Group. Mapster is an independent business and is not affiliated with, endorsed by or sponsored by Navico. PayFast and PostNet are trademarks of their respective owners.

11. Changes to these terms

We may update these terms from time to time. The version published on this page when you place an order applies to that order.

12. Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute is subject to the jurisdiction of the South African courts, without affecting your right to approach the National Consumer Commission or a consumer court.
